Terms of Service

These Terms of Service ("Terms") form a legal agreement between you and the independent developer of Vita / 100old.app ("we", "us"). Please read them carefully before accessing, registering for, or using the Service. By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms in full.

If you do not agree to any part of these Terms, do not use the Service.

Vita is a personal health-tracking iOS app; 100old.app is the companion web application (collectively, the "Service"). Core functions include: aggregating and visualizing health data from Apple Health / WHOOP, providing rule-based training suggestions, generating personalized health insights via large language models, and logging nutrition and journal entries. The Service does not provide medical diagnosis or treatment.

• You must be at least 13 years old; if you are under 18, you must have your legal guardian's consent to use the Service.
• You must be able to enter into a legally binding contract.
• Use of the Service must not be prohibited by the laws of your country / region.
• We must not have previously suspended or terminated your access.

To use the Service you need to create an account. You agree to:

• Provide accurate, complete, current registration information.
• Keep your credentials confidential — you are responsible for all activity under your account.
• Notify us immediately if you discover unauthorized access to your account.
• Not share your account with others without our written consent.

We use Supabase Auth and store passwords as salted hashes. We recommend a strong, non-reused password.

You may not (and may not help or encourage others to):

• Use the Service in violation of any law or third-party right.
• Reverse-engineer, decompile, or attempt to extract source code, except where this is expressly permitted by applicable law.
• Access the Service or its systems without authorization.
• Abuse the API: malicious requests, unreasonable rate, vulnerability scanning, or scraping other users' data.
• Upload false, misleading, or third-party personal information; impersonate anyone.
• Upload viruses, trojans, ransomware, or any other harmful code.
• Use the Service for medical diagnosis, treatment, clinical trials, or any other medical purpose.
• Use automated tooling for registration or bulk operations (bots, scrapers, etc.).

Except for content you upload, the Service and all of its content (including but not limited to code, design, icons, the Vita mascot, copy, and documentation) are the intellectual property of us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You may not copy, modify, distribute, sell, rent, or sublicense any part of the Service without our prior written authorization.

You retain all rights to the content you upload or create (avatar images, profile fields, health data, journal entries, questions, etc.). You grant us a limited license, solely for the purpose of providing the Service to you (including sending your questions to the AI model provider to generate replies), to use that content. The license terminates automatically when you delete the content or your account.

You represent and warrant that you have all rights necessary to upload or create your User Content and that it does not infringe any third-party right.

The Service relies on third-party components (see Section 6 of the Privacy Policy). Those services are operated by their respective providers and are subject to their own terms. We are not responsible for the availability, content, or behavior of any third-party service, although we use commercially reasonable efforts to choose reputable providers.

If you connect WHOOP, Apple Health, Sign in with Apple, Google Sign-In, etc., via the Service, your relationship with each of those third parties is governed by their terms, not these.

The Service is currently fully free. We reserve the right to introduce paid subscriptions or one-time paid features in the future. When subscriptions launch, the following terms will apply:

• Auto-renewal: iOS App Store subscriptions renew automatically 24 hours before the end of the current period unless you cancel via Settings → Apple ID → Subscriptions at least 24 hours before renewal.
• Cancellation: you must cancel through the iOS subscription manager; deleting the app does not cancel a subscription.
• Refunds: all refund requests are processed directly by Apple in accordance with Apple's refund policy.
• Price changes: we will give you at least 30 days' notice of a price change; if you do not agree, you may cancel before the new price takes effect.
• Free trials: if a free trial is offered, it will convert to a paid subscription unless cancelled before the trial period ends.

This section is a placeholder; when subscriptions launch, this section will be updated or full pricing rules will be disclosed in-app.

The Service is provided "as is" and "as available", without warranty of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, availability, or accuracy.

We do not warrant that:

• The Service will always be available, uninterrupted, error-free, or secure.
• The Service will meet all of your expectations.
• Data displayed or AI suggestions generated by the Service are absolutely accurate.
• Any defects in the Service will be corrected.

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, punitive, or consequential damages (including but not limited to loss of profit, loss of data, loss of goodwill, health-related harm, or delayed diagnosis / treatment) arising out of or in connection with your use of or inability to use the Service.

In any case, our aggregate liability under these Terms shall not exceed the amount you actually paid us for the Service in the preceding 12 months; if the Service was free to you during that period, that amount is zero (USD 0 / CNY 0 / HKD 0).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the foregoing applies to the fullest extent permitted by law.

You agree to defend, indemnify, and hold us, our affiliates, employees, and agents harmless from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your violation of any applicable law or any third-party right; (c) your User Content; (d) your misuse of the Service.

You may terminate your account at any time via the in-app "Delete account" flow or by email.

We may also terminate or suspend your access if: (a) you breach these Terms; (b) we suspect you are violating the law or harming others; (c) we decide to discontinue all or part of the Service.

Sections that by their nature should survive termination (e.g., "Intellectual Property", "Disclaimers", "Limitation of Liability", "Indemnification", "Governing Law") remain in effect.

These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict-of-laws rules.

Note for users in mainland China: nothing in this section shall be construed to deprive users located in mainland China of any rights granted by the PRC Consumer Rights Protection Law, the Personal Information Protection Law (PIPL), the Civil Code, or any other mandatory provisions of PRC law. Any part of these Terms that conflicts with such mandatory provisions is unenforceable against users located in mainland China.

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to arbitration by the Hong Kong International Arbitration Centre (HKIAC) under its rules then in force; the seat of arbitration shall be Hong Kong. The arbitral award shall be final and binding on the parties.

Under applicable law, EU users, UK users, California consumers, and others retain the right to file suit in courts of competent jurisdiction; these Terms do not deprive you of that statutory right.

We may modify these Terms from time to time. Changes will be announced through in-app notice or email before they take effect. Material changes become binding when you continue to use the Service after the effective date. If you disagree, please stop using the Service and delete your account.
